DePuy Hip Implant Recall
If you have had a Hip Implant, you may be subject to the DePuy ASR Recall and could be entitled to damages related to serious defects in the Hip Implant device. Call our office for more information and a free consultation about your legal rights and eligibility for a significant recovery.
The Recall comes after DePuy's ASR Hip Resurfacing System and the ASR XL Acetabular System were aggressively marketed for approximately six years between 2003 and 2010 and implanted in a total of about 93, 000 patients.
The Recall was prompted by reports from the National Hip Registry and National Institutes of Health citing the alarming number of defects and the high revision surgery rate for the device. Approximately one in eight patients with ASR Hips will require painful second surgeries to replace their failed implants.
The ASR Hip implants fail by becoming loose, fracturing the bone around the implant, or dislocating the implant's ball and socket. Defective ASR hip replacements cause swelling, pain, and difficulty walking. Metal particles can flake off of the ASR Hip replacement and enter the bloodstream, poisoning the body with toxic Chromium and Cobalt.
The ASR hip system has been manufactured and implanted in the United States since back in July 2003. This means that individuals that have their hips replaced on and after July 2003 should determine if they received a DePuy ASR and are affected by the DePuy ASR hip recall. You can contact your orthopedic surgeon or the hospital where the surgery took place to find out whether you received an ASR DePuy Hip.
DePuy has offered to cover the costs of monitoring and treatment for the defective devices, but their offer would jeopardize your rights to compensation for pain and suffering, lost wages, decreased earning capacity, and potential punitive damages for the high degree of negligence exhibited here. It appears that the reimbursement is limited to "out of pocket expenses" and is only considered if the patient agrees to give DePuy a written authorization to retrieve the patient's medical records and to allow DePuy to take possession of the actual device after it is removed.
We are advising our clients not to sign any such releases or allow DePuy to retain the hip device. Patients with DePuy's defective hip implants should be allowed to recover a full measure of damages. If you are one of the unfortunate victims of DePuy's negligence, you may want to consider a DePuy ASR Hip Recall Lawsuit to get the compensation you deserve.
